Maryland’s $3.63 tipped wage — and the counties that require more

Maryland sets its minimum wage at $15.00 an hour. If you earn more than $30 a month in tips, your employer may pay a cash wage as low as $3.63 an hour and claim a tip credit of up to $11.37, so long as your tips bring you to at least $15.00.

That $15.00 floor is the statewide number, but two counties run their own higher schedules. Montgomery County’s minimum climbs with employer size — reaching $18.00 an hour for the largest employers on July 1, 2026 — and Howard County sets its own rate as well. In those counties your tips must bring you up to the local minimum, not just the state one, even though the tipped cash wage stays at $3.63.

Your employer must hand you a wage statement each pay period

Maryland has a rule many tipped workers do not know about. A restaurant employer that uses the tip credit must give you a written or electronic wage statement for every pay period. That statement has to show your effective hourly rate — your cash wages plus tips — for the tip-credit hours you worked in each workweek.

This exists so you can check the math yourself. If the statement shows you fell below the applicable minimum wage in any week, the employer owes you the difference for that week.

If tips fall short, the employer covers the gap

The tip credit does not let your employer pay you under the minimum. In any workweek where your cash wage plus tips do not average at least the applicable minimum wage — the state rate, or the higher Montgomery or Howard County rate where it applies — your employer must make up the shortfall in that paycheck.

Tip pooling in Maryland

Maryland follows the federal baseline: employers may require tip pooling. If your employer takes the tip credit (pays $3.63/hr cash), the pool may only include customarily tipped workers — servers, bussers, bartenders, runners, hosts. Back-of-house can only be included if everyone is paid full minimum wage with no tip credit. Managers and supervisors are always excluded.

One federal rule applies everywhere: managers and supervisors can never take from a tip pool. Separately, credit card processing fees may only be deducted from tips where state law allows it.
