A tip credit lets an employer count your tips toward the minimum wage it owes you. Rates reviewed July 2026. Rates change — confirm with the Maine labor department. Not legal advice.

What's specific to Maine

Maine requires the tipped cash wage to equal at least half the minimum wage, adjusted annually for inflation.

Maine’s wage rises every year, and tipped workers get at least half of it

Maine’s minimum wage is $15.10 an hour as of January 1, 2026, and it adjusts each year for inflation. For tipped workers — those who earn more than $191 a month in tips — an employer may pay a direct cash wage of $7.55, exactly half the minimum, and take a tip credit for the rest.

The tip credit only works if it gets you to the full wage. In any week where your $7.55 direct wage plus tips do not average at least $15.10 an hour, your employer must pay the difference.

Portland and Rockland set higher local minimums

Two Maine cities require more than the state. Portland’s minimum wage is $16.75 an hour for 2026, with a tipped direct wage of $8.38, half the city rate. Rockland’s minimum is $16.00, with a tipped direct wage of $8.00.

The rate that applies is set by where you actually perform the work. If you work a shift in Portland, the Portland wage governs that shift, even if your employer is based elsewhere.

Where to turn if you are underpaid

If your direct wage plus tips do not reach the applicable minimum — state, Portland, or Rockland — your employer owes you the shortfall. You can file a wage complaint with the Maine Department of Labor, which enforces the state minimum wage and tip rules.

Tip pooling in Maine

Maine follows the federal baseline: employers may require tip pooling. If your employer takes the tip credit (pays $7.55/hr cash), the pool may only include customarily tipped workers — servers, bussers, bartenders, runners, hosts. Back-of-house can only be included if everyone is paid full minimum wage with no tip credit. Managers and supervisors are always excluded.

One federal rule applies everywhere: managers and supervisors can never take from a tip pool. Separately, credit card processing fees may only be deducted from tips where state law allows it.

What this means for your tip-out

Because part of your legal wage in Maine comes from tips, the employer's tip credit assumes those tips reached you. Use the tip-out calculator to split a shift by your house's percentages or by hours, and see standard tip-out percentages to check whether your house's rates are typical.
